Terms of business

for people who like to do business

The following terms and conditions are designed to form an agreement between us. These terms are intentionally designed to be clear and easy to understand. They are also, in my opinion, very fair and reasonable. I’d rather do all this over a pint and a handshake, but for clarity let’s keep it simple so that we both understand one another. If you need any clarification please do not hesitate to contact me.

Price and billing

BarWaiter costs, by the day, the same as the average price of a half-pint of beer in the UK. According to the Morning Advertiser (7th August 2020), the average price for a pint in the UK is £3.94, so half of that is £1.97.

BarWaiter is billed monthly and is calculated at £1.97 per day. £1.97 per day, multiplied by 365 days (1 year) gives a total of £719.05, which when divided by 12 months gives a monthly figure of £59.92.

Payment of £59.92 (per venue) is due on the last day of every month, for as long as you use BarWaiter. At some point, it may be necessary to add VAT to this figure.

If I do not pay my bar tab I don’t expect you to serve me any more drinks until l have settled my bill. BarWaiter works exactly the same. If payment is not received by the last day in the month BarWaiter will be suspended for any unpaid accounts. When payment is made on any suspended account the service will be resumed by 10am the following day.

Cancellation

Things are a bit tricky right now, and I really get that. So, I don’t want you to over commit. If a new lockdown is imposed you may need to close for a period of time. You may cancel or put your subscription on hold at any time. Simply email [email protected] and tell me what you want to do. No questions asked.

BarWaiter is billed at the end of each month, so a month in advance. Entering a new month will attract a fee for that month, but no more. So you will never owe more than one month’s subscription of £59.92.

Service

Provision of BarWaiter

BarWaiter is a subscription-based digital product. It is hosted on a robust, secure server by a third-party hosting specialist. The software uses some of the very best security practices available.

I will maintain and update BarWaiter periodically with the latest software and best-practice procedures. I will also add new features at my own discretion, as and when appropriate.

No-one wants a disruption in service, and with that in mind, BarWaiter has been designed to be robust and resilient. However, with the best will in the world, it is not possible for me to cover every eventuality. As an example, this could be problems with your internet connection, or lost, damaged, or malfunctioning hardware like your laptop or tablet.

Alternatively, it could be problems with the server or the software itself. Where a problem exists within systems that I can control I will act to restore services at the first opportunity.

In the extremely unlikely event of a disruption to service, I strongly advise that you have a rudimentary back-up system in place to prevent any major disruption to your business.

BarWaiter is provided as an enhancement to your current business activities. I accept no responsibility or liability for loss of business due to down time as a result of disruption to service of BarWaiter how so ever caused.

Backups

Back-ups are taken at regular intervals. The database is backed-up daily and the files weekly. In the extremely unlikely event of data loss, BarWaiter will be restored to the last good backup available.

Content population

As easy as it is, I appreciate that not everyone has the time or inclination to populate BarWaiter with their stock. With this in mind, I do offer a population service at my own discretion. I will require the following information:

  • Product name
  • Description
  • Product photograph – it is your responsibility to ensure you have permission for use
  • Variation details – volume, mixers, etc.
  • Price, or prices where variations differ

It will be your responsibility to proof read and check all descriptions and prices.

A charge will be made for each product entered in to BarWaiter on your behalf. Details of charges can be found in the pricing information page.

Ownership and copyright

A subscription to BarWaiter confers no rights to ownership of the BarWaiter application. BarWaiter, it’s processes and procedures remain the intellectual property of myself, John Stutely, and the owners of any third-party software or platforms that I choose to use.

All content, and the Copyright thereof, published on your BarWaiter application, is your own responsibility. I accept no liability for copyright infringement, misleading or inaccurate copy, or incorrect prices.

Suggestions for improvement or upgrades are very welcome and any ideas put forward by yourself will be considered for development. However, BarWaiter is provided as-is and no modifications to the system will be made to suit any individual case without clear agreement.

User agreement

BarWaiter may only be used for the general purpose of providing food and drinks in a Pub, Bar, Restaurant, Café, Hotel, or similar. BarWaiter may not be used for any other purpose without written permission. Should BarWaiter be used for any unauthorised purpose the account will be suspended immediately.

You agree that you will not hold myself, BarWaiter or any associated partner liable for any loss of business as a result of any disruption to the service of BarWaiter.

By agreeing to these terms you are confirming that you have the authority to act for or on behalf of the venue(s).
